1. Who Are We?

Butlaroo Services B.V. ("Butlaroo," "we," or "us") provides SaaS services to hospitality businesses, including QR ordering solutions, kiosk systems, click & collect, online ordering, point-of-sale (POS) systems, and kitchen display systems (KDS).

2. Our Role

Butlaroo acts as the data controller for personal data that we process for our own purposes (account management, billing, security, product development). This Privacy Policy applies to such processing activities.

When a hospitality business operator (Customer) uses the Butlaroo platform, we process personal data of its end users (guests/consumers) as a data processor, solely on behalf of the Customer. In that capacity, the Customer is the data controller. The terms governing this arrangement are set out in our Data Processing Agreement (DPA). End users should contact the relevant hospitality business operator for information about the processing of their personal data.

3. What Personal Data Do We Process and Why?

3.1 Customers and Their Employees

When you create an account or use the Platform, we process data such as your name, contact details, business information, login credentials, usage logs, billing information, and communications between us.

We use this data for:

• Performance of the contract: account management, billing, customer support;

• Legitimate interest: fraud prevention, security, product improvement, analytics, commercial communications;

• Legal obligations: tax record-keeping requirements, disclosure to competent authorities.

3.2 Visitors to Our Website

When you visit butlaroo.com, we process data such as your IP address, browser and device information, pages visited, and any information submitted through forms.

We use this data to operate and improve our website, to respond to contact requests, and, with your consent, for marketing purposes.

3.3 Business Contacts

We process the names, contact details, and business information of business contacts on the basis of legitimate interest or the performance of a contract.

Where we rely on legitimate interest, we have conducted a balancing test between our interest and your privacy interest. You have the right to object to such processing (see Section 6).

4. Retention Periods

We do not retain personal data longer than necessary for the purposes for which it was collected, unless a longer retention period is required by law.

5. Sharing with Third Parties

We share your personal data only when necessary:

• Sub-processors: We engage carefully selected sub-processors (hosting, payments, email, analytics, customer support). We enter into data processing agreements with all such parties.

• Competent authorities: Where required by a legal obligation or court order.

• Business transfers: In the event of a merger, acquisition, or restructuring, while maintaining the current level of protection.

We do not sell your personal data to third parties.

Transfers Outside the EEA: If a sub-processor processes personal data outside the European Economic Area, we safeguard such transfers by means of adequacy decisions, standard contractual clauses, or other appropriate safeguards in accordance with the GDPR.

6. Your Rights

Under the GDPR, you have the right to access, rectification, erasure, restriction of processing, data portability, and the right to object. Where processing is based on your consent, you may withdraw that consent at any time.

We implement appropriate technical and organizational measures to protect your personal data, including encryption, access controls, monitoring, and incident response procedures. In the event of a data breach that poses a high risk to your rights, we will notify you in accordance with our statutory reporting obligations.
